BENNINGTON TOWNSHIP
Regular Board Meeting

The Bennington Township regular board meeting was called to order by Supervisor Lee Ash on July 1, 2019, 7:00pm, at the Township Hall.

Present: Jim Forsythe, Matt Dutcher, Lee Ash, Nancy Zdunic, Donna Ash.

L. Ash moved to approve the agenda as printed. Second by Dutcher. Motion carried.
Zdunic moved to approve the minutes for the June 3, 2019 regular board meeting as printed. Second by Forsythe. All board members in favor. Motion carried.
Forsythe moved to approve the Treasurer’s report as presented. Seconded by L. Ash. All board members in favor. Motion carried.
Forsythe moved to pay bills as presented in the amount of $17,516.56. Seconded by Dutcher. All board members in favor. Motion carried.

Public Comment:
Co Comm Garber – Update. Hired new Finance Director. Audit is not complete at this time.

Board Reports:

Library – Garber – Update. Audit is complete.

Plan Comm – D. Ash – Reviewed one rezoning and three variances and discussed the new Recreational Marijuana rules.

• Dutcher moved to recommend a denial of Rezoning application #PREZ19-02 to rezone a parcel from A-2 (Agricultural Production Rural Residential) to M-1 (Light Industrial) for Jason Gardiner/Mark Birkenbach on the Northwest corner of Tyrrell Road and M-52, Owosso, parcel  #010-33-200-003-04 because it is not part of the current Bennington Township Land Use Plan for this type of zoning in this area and it is not next to or near zoning of this type. Second by L. Ash.  Motion carried.
• Forsythe moved to concur with the Township Planning Commission and approve Variance application #PZBA19-015 for Michael Mankey to allow an addition to a single-family residential structure within the required 100’ waterfront setback by approximately 31’ at 5030 Lake Dr., Owosso, parcel #010-44-014-001. Second by Zdunic. Motion carried.
• Forsythe moved to concur with the Township Planning Commission and approve Variance application #PZBA10-018 for Anthony Wyzga/Edward & Sylvis Hachenski Trust to allow an addition to a single-family residential structure which encroaches approximately 5’ into the required 100’ waterfront setback at 4851 Apache Path, Owosso, parcel #010-52-053-000 with the condition that a letter of approval is received from the Lake Manitou Association. Second by Zdunic. Motion carried.
• Forsythe moved to concur with the Township Planning Commission and approve Variance application #PZBA19-19 for Don Horton/Rebecca & Deborah Ropp to allow the creation of a parcel to have frontage on a legally noncomforming private road at 1955 W. Hibbard Rd., Owosso, Parcel #010-03-200-001-03. Second by L. Ash. Motion carried.
• Discussion of the new Recreational marijuana rules. Will request Doug Piggott form Rowe Professional Services Company to attend a meeting to discuss the Township’s options.

Roads – L. Ash – Currently mowing roadsides. Will begin mineral brine application soon.

New Business:

Shiawassee Firefighters Memorial – Sarah Moorodian spoke regarding a request for approval of a Charitable Gaming License. Zdunic moved to adopt a resolution to approve the request from Shiawassee Firefighters Memorial  to be recognized as a nonprofit organization operating in the community for the purpose of obtaining charitable game licenses. Second by Forsythe.  All board members in favor. Motion carried.

SATA Commitment – Forsythe moved to make a commitment to Shiawassee Area Transportation Agency for services for a term of October 1, 2019 – September 30, 2020 at a cost not to exceed $15,365.51. Second by L. Ash.  All board members in favor. Motion carried.

Parking Lot Repairs – Will look into some options for next meeting.

Fence – Dutcher moved to approve the proposal from Spartan Fence to replace the split rail fence at the Township Hall with split rail fencing at a cost of $7,775.00. Second by Zdunic.  All board members in favor. Motion carried.

Veteran Village Fundraiser Request – The Township has no ordinances or regulations regarding roadside donations.

Forsythe moved to adjourn. Second by L. Ash.  Motion carried.
